Introduction

Environmental management in Congo Brazzaville is governed through its constitution and the environmental protection law no. 003/91 of April 1991.

The Congolese constitution of January 2002 gives an important place to the environment through several articles on environmental protection and health (Articles 35, 36, 37, 38, and 63). The objectives of the environmental protection law are to:

  • Strengthen the legislation on the exploitation of dangerous, unhealthy or unfriendly facilities, planning and development and to protect and preserve wildlife and flora, marine and river resources. 
  • Manage, maintain, restore and protect natural, cultural and historical resources. 
  • Prevent and fight against the damage to the environment and health of people or their property.

Environmental assessment in particular is governed through decree 2009/415 from 2009. This decree lays down the scope, contents and procedures for the environmental and social impact study and notice. One of the peculiarities of this decree is that it includes plans and programs as part of the definition of a project. Therefore, Strategic Environmental Assessment (SEA) is identical to environmental and social impact assessment.
